FDA Registration and U.S. Agent Requirements



Registrants of foreign establishments subject to this part must designate a single United States agent. The United States agent must reside or maintain a place of business in the United States and may not be a mailbox, answering machine or service, or another place where a person acting as the United States agent is not physically present.
The United States agent is responsible for



1) Reviewing, disseminating, routing, and responding to all communications from FDA

2) Responding to questions concerning that food that is imported to the United States;

3) Assisting FDA in scheduling inspections; and If FDA is unable to contact a foreign registrant directly or expeditiously FDA may provide the information and/or documents to the United States agent

FDA Detention and DWPE Assistance



FDA-regulated goods find their products subject to seizure and detention upon importation into the United States for the failure to comply with labeling regulations and other applicable FDA requirements. These detentions can result in costly and time-consuming delays that, at times, halt distribution. FDA Related SOLUTIONS & projects



U.S. FDA Food Canning Establishment (FCE)



All facilities that manufacture, process, pack, or hold food for human or animal consumption in the United States are required to register with the U.S. Food and Drug Administration (FDA), but food facilities that work with Acidified or Low Acid canned foods are considered to be Food Canning Establishments (FCE) and need an additional registration.


If an FCE does not follow FDA registration and process filing requirements, FDA may detain the facility’s Low Acid or Acidified foods at the point of entry until the products are brought into compliance, destroyed, or re-exported.

At this time, FDA recognizes the DUNS number, assigned and managed by D&B, as an acceptable UFI for the purpose of compliance with the FSVP regulation.
